The Effect of the Economy on the Nonprofit Sector, March - May 2009

This report presents the results from GuideStar’s second nonprofit economic survey for 2009. The findings show that nonprofits continued to struggle between March and May 2009. A majority (52 percent) reported decreased contributions, and 58 percent said that demand for their services had increased.

Some 2,098 public charities and 181 private foundations participated in the survey. (Read the Executive Summary.)

The Private Inurement Prohibition, Excess Compensation, Intermediate Sanctions, and the IRS's Rebuttable Presumption - A Basic Primer for 501(c)(3) Public Charities

 

The new Form 990 requires organizations to indicate how they established the compensation paid to certain officers, directors, trustees, key employees and their highest compensated employees. The consequences for allowing these “charity insiders” to benefit improperly from the organization (i.e. private inurement) can carry stiff financial penalties or even revocation of tax-exempt status.

In this timely paper, attorney Karl Emerson explains private inurement, provides the legal perspective on issues such as excessive compensation, intermediate sanctions, and determining “fair and reasonable” compensation. You will also learn how a charity can establish a “rebuttable presumption” that will demonstrate to the IRS that the organization followed appropriate steps in setting compensation.

The Effect of the Economy on the Nonprofit Sector, October 2008-February 2009

In March 2009, representatives of 2,979 charities and private foundations participated in a GuideStar survey designed to gauge the effect of the economy on the American nonprofit sector between October 2008 and February 2009. This report presents the results of that survey, which show that the impact was severe for a majority of the organizations. It also describes what the nonprofits have done to cope with the financial challenges they are facing.

This survey is the first of three focusing on nonprofits and the economy that GuideStar will conduct in 2009. The second will take place June 8-22, the third October 1-14. A report on each will be published for free download. (Read the Executive Summary.)
